A debt to society

We promised we would bring you up to speed on some of Ms. Kinder's debts and the timely, or untimely paying of them. We don't lie and we don't speak empty words, you should know it by now.


So let's dive right down into this rabbit hole, shall we? We've all heard the saying an asset to society. But, what about a debt to society? Don't you think we should recognize those, especially when someone is running for public office, right? If this person is going to be in charge of a budget for the whole lot of us, they best have a decent track record of paying their debts, should they not? How about making right on money judgements against them? What do you think is a reasonable amount of time for a debt to be paid? How far should someone have to go to seek the money you owe them?


The year is 2004, amount awarded $725.77. This seems easy, pay what you owe and all is good, right? Well, if you're Ms. Kinder, you don't do that. Now for the plaintiff, who was awarded a judgement in this case, they must seek to get paid somehow.

Apparently it's not so simple for some of us to pay our debts, so here comes praecipe for writ of attachment. But, what the heck does that even mean? As always, we're so glad you asked!

See that last bit? "Judgement sought to be enforced arose out of a residential lease, for unpaid rent or for damages to the property." This means a judge agreed that Ms. Kinder owed this money to the landlord, and she failed to pay it. There was no appeal in this case, meaning she fought the judgement. No, this went all the way to a writ of attachment. Why is it OK for her to force someone to go to these lengths to recover monies owed? But, it doesn't stop here with just this case.... does it? No folks, we've got more to explore. Let's continue on to November of 2004. MASA files a lien against Kinder, and her now ex-husband, for the amount of $424.17. Again, forcing someone to chase her down to get the money they are owed. They did file a satisfaction on this case in 2009, which is 5 years of them waiting and hoping they would get paid. 5 years!


The term of a Mayor is for 4 years. What kind of "push it off until I decide to finally deal with it" kind of debt are we going to be in IF she were to get into office? Will she suggest that we just wait until another day, another month, another few years?

These businesses and/or individuals provided a service to Ms. Kinder and she stuck them with that bad debt for years. Heck, we don't even know if the landlord ever actually got paid.


You've got to be thinking, that's it, right? Maybe she just had a bad year and she was recovering from that. Yeah, but then there's this article of agreement. Here we can think, this is great, someone is finally giving her a chance at purchasing a place. We agree, it's great for folks to own their homes. It's very generous when folks do it on an article of agreement. In case you're unaware of what an article of agreement is, we will provide you with that information.


An installment contract (also called a land contract or articles of agreement for warranty deed or contract for deed) is an agreement between a real estate seller and buyer, under which the buyer agrees to pay to the seller the purchase price plus interest in installments over a set period of time.

This begins in March of 2005. Any guesses how many years this lasts? If you guessed a few years, you're pretty close. In January of 2008 Jaime agreed to surrender the deed for this property in lieu of foreclosure. Thus meaning, she had been defaulting on her obligation to the sellers. Thankfully, the article of agreement was in place to protect them and they recovered the property.

A grantee is the recipient of something, such as a college grant or real estate property. A grantor is a person or entity that transfers to another person or entity the interest or ownership rights to an asset. Legal documents, such as deeds, detail the transfer of assets between grantors and grantees. There you have it folks, we must be done now. Well...... we're not. It seems that the pattern of default continues. This time, the year is 2015, the amount is $1,239.97.


In this instance, there was a default judgement entered against Ms. Kinder. This occurs whenever someone decides not to show up to the court date. But wait, maybe something came up, maybe she had reason not to appear? Really? Can we be making excuses at this point? Do you see an appeal on this docket sheet? No, there's no appeal. This means, she did not dispute the judgement against her, therefore she owes this money. We can see here that after 5 years this judgement expired. Since we're sure you're curious what this means, we'll tell you. This happens whenever so much time has lapsed since the judgement and no payments have been made, no writ of attachment or anything like that. I bet you're thinking, well they must not have needed the money or not cared.

Unfortunately, the plaintiff in this case passed away in 2017 and this would be why nothing further occurred. The family may not have been aware of this case, or maybe they had enough on their plate that they chose not to pursue it. You would think though, that a decent human being would show an inkling of sympathy and make this right? Even if the individual has passed on, generally there is still a trust or an estate. It most likely could have helped cover the cost of funeral expenses, but unfortunately this money just went uncollected.


We'll conclude this saga (for now) with one last case. The year is 2018, this time Ms. Kinder was actually the individual who won the judgement. Although, a quick internet search might tell us why she was successful in this case. First, the details of the matter.


Did you see that total? $5,058.71

Now you're probably confused. Who the heck or what the heck is CACH, LLC and why is this even relevant? She won, right? We like the way you ask all these questions, and once again we are so glad you did.


It all starts with an account that you opened. This may have been a credit card, or a loan from a lender or installment loan provider. You used this account (credit card, store card, loan). You missed one or more of your scheduled payments. Over time if you can’t keep up with your required payments, the initial owner or originator of the account will likely “charge-off” the account without being repaid.

What does this mean?

When your account is charged off, it means that the creditor has determined that you’re not likely to bring your account back to good standing and has decided to prevent you from making any additional purchases on the account. After charge off, some creditors choose to sell your account to another party. This does not mean the debt goes away. It just means that you now owe the debt to the new owner.


But wait, she won.....

This victory isn't so great. All this means is another company or individual didn't get paid the money they were due from Ms. Kinder.


You have to wonder, why would anyone want to entrust a Cities finances to such an individual? If someone shows time and time again to not only acquire the debt, but to go without paying that debt, or at least not doing so in a timely fashion, who's to say this very scenario wouldn't occur in our City under this kind of leadership. Oh, and those who chose to get on the campaign march with her, did they even look into who they were endorsing? Isn't anyone else looking into this? Why are so few people concerned with the past of an individual, especially one that clearly shows a sign of financial irresponsibility. We haven't even touched on the fact that all of this is morally wrong! Is this really the best candidate for the position? Is she really the person you think she portrays to be, or is this just another charade to get what she wants in life at the expense of others? Don't allow this to be the downfall of our City. Question this, question those who choose to support this. We can't stand by with idle hands and watch as the charade is played out in front of us, we can not be silent on this. We as a City need to choose a leader who has enough decency to pay their debt to society, and to be accountable for their actions and their doings. We need a Mayor who is financially responsible and shows stability in their endeavors.


This story isn't done, we've only just begun.
